Terms of sale

These are the standard terms on which Cuong Thinh Meraki Company Limited ("CTM") sells its products to business customers. The proforma invoice or sales contract for your order sets out the final terms and takes precedence over this page.

1. Quotations and prices

Prices are quoted per piece, FOB Ho Chi Minh City (Cat Lai or Cai Mep port) under Incoterms® 2020, in US dollars unless agreed otherwise. A quotation becomes an order when you sign the proforma invoice or sales contract and the deposit is received.

2. Minimum order quantity

The minimum order is usually 50–100 pieces per model, depending on size and design. The MOQ for each item is stated in our quotation.

3. Payment

30% deposit by bank transfer (T/T) when the order is placed. The 70% balance is paid against a copy of the bill of lading. Original shipping documents, or a telex release, are issued after the balance is received.

4. Samples, colours and moulds

Mass production starts only after you approve a sample or colour chip. The approved sample is the reference for colour and finish; colours shown on screen are approximate. Hand-made pieces may show small variations in colour and texture. The fee for a new mould depends on size and design and is quoted for each project.

5. Production and delivery

Production takes about 30–45 days after the deposit is received and the sample is approved. We confirm the estimated loading date on the proforma invoice and send photos during production and before the container is sealed.

6. Inspection

You may send your own QC team or a third-party inspection company to check the goods at our factory before shipment, at your cost. Please let us know the inspection date in advance.

7. Packing and shipping

Goods are packed in padded export cartons and palletised, or packed to your e-commerce standard if agreed. Under FOB terms, risk passes to the buyer when the goods are loaded on board the vessel at the port of shipment.

8. Warranty and claims

See our warranty page. Please report visible defects as soon as possible after the goods arrive, with photos and the order number.

9. Intellectual property

Designs, drawings and moulds made for your own (OEM) design are used only for your orders and are not sold to other customers.
